In a significant development, the former CEO of Theranos, Elizabeth Holmes, who came under fire for a scandal involving a blood-testing hoax that momentarily skyrocketed her to fame and fortune, seems to be on the verge of facing her impending imprisonment. This follows the decision of an appeals court on Tuesday to dismiss her attempt to stay out of jail while she embarks on efforts to challenge her conviction.
Elizabeth Holmes attempted to postpone her 11-year prison sentence
This resolution by the Ninth Circuit Court of Appeals was declared nearly three weeks subsequent to Holmes’s eleventh-hour legal strategy to postpone the initiation of her 11-year prison sentence. Prior to this, she was instructed by U.S. District Judge Edward Davila to give herself up to the law enforcement authorities on the 27th of April. Judge Davila had previously determined her sentence in November.
It now falls upon Judge Davila to specify a fresh date for the 39-year-old Holmes, who presently resides in the San Diego area, to bid farewell to her home and report to prison.
This punitive action will have the effect of estranging Holmes from her current partner, William “Billy” Evans, and their two young children – a 1-year-old son named William and a 3-month-old daughter, Invicta. Holmes became pregnant with Invicta, a name of Latin origin signifying “invincible” or “undefeated,” subsequent to a jury finding her guilty on four charges of fraud and conspiracy in January 2022.
Judge Davila has put forth a recommendation for Holmes to carry out her sentence at a women’s prison located in Bryan, Texas. Information has yet to be revealed regarding whether the federal Bureau of Prisons has accepted this proposal or decided to assign Holmes to a different facility.
Former Theranos partner Ramesh Balwani serving 13-year prison sentence
Holmes’s former intimate partner and high-ranking officer at Theranos, Ramesh “Sunny” Balwani, embarked on his nearly 13-year prison sentence in April. He was found guilty on 12 charges of fraud and conspiracy during a separate trial held in July of last year. Balwani, aged 57, was incarcerated in a prison in Southern California after his bid to stay free on bail while appealing his conviction was unsuccessful, mirroring Holmes’s own predicament.
The judgement passed against Holmes was the outcome of a 46-day trial that involved testimonies and other evidences, shedding light on a culture of rampant greed and overconfidence that has permeated Silicon Valley, particularly as technology has increasingly become a profound influence on societal and economic aspects over the past two decades.
One of the most captivating instances during the trial occurred when Holmes took to the witness stand to defend herself. Apart from sharing the story of how she established Theranos after leaving Stanford University at a young age, Holmes leveled accusations of emotional and sexual abuse against Balwani. She further claimed that she never lost faith in Theranos’s potential.
